Update on the Counties of Hawaii new Transient Accommodations Tax (TAT)

All counties have now approved a new 3% Transient Accommodations Tax (TAT) in addition to the prior taxes:

Kauai Effective October 1st, 2021

Maui County Effective November 1st, 2021

Honolulu County Effective January 1st, 2022

Hawaii County Effective January 1st, 2022

All reservations (contracts) written before the effective date are not required to pay the additional tax UNLESS your contracts provide for any increase in taxes.  As an example, if your contracts state:

“Estimated government taxes and fees”, “Changes in taxes or fees implemented after booking will affect the total room price”, “Additional charges may apply”, “Guest is responsible for all taxes at time of check-in”

then you must collect and pay the additional 3% tax on those reservations made before the effective date.

How are taxes collected is interesting: Act 1 stated that the counties must collect their own tax. 

As of this writing, there are no new forms and you are considered filed timely when you file the States TAT-1 form timely.  However, there is nowhere on the form to indicate if there are receipts prior to the effective date.

Payments must be made separately to the counties.

Kauai is only accepting online payments, ACH or a credit card payment with a fee.

Maui and Hawaii Counties are accepting online payment via ACH (sites say it takes 4 days to process these payments) or mail in checks with a voucher you can download from their sites.

Honolulu County – We have no information at this time.
